DEFINITIONS

(A). The following rules and regulations ( as amended from time to time ) ( “The Rules”) shall govern the use of any vessel or its gear and equipment (“Vessels”) and any vehicle (“Vehicle”) by any person, firm, or company or their family, visitors, or crew (“Owners”) on or over the Marina and any part of the premises or facilities at the Ao Po Grand Marina Co., Ltd. (“APGM”) owned by Ao Po Grand Marina Co., Ltd. (“APGM”)  whose Management, Marina Manager, and staff are included within the expression “The Company” and are authorized to apply these Rules. The Company has the right to evict Captain, crew, or yacht at any time, and in addition to the right to terminate the berth contract.

“กฎข้อบังคับ” หมายถึง  กฎข้อบังคับซึ่งอาจมีการแก้ไขเพิ่มเติมเป็นครั้งคราวขึ้นอยู่กับดุลยพินิจของบริษัท อ่าวปอ แกรนด์ มารีน่า จำกัด เป็นข้อบังคับสำหรับควบคุมการใช้เรือใด ๆ หรือเกียร์และอุปกรณ์ของเรือเหล่านั้น

“เรือ” และ “ยานพาหนะ” หมายถึง เรือ หรือ ยานพาหนะใดใด

“เจ้าของ” หมายถึง บุคคลหรือองค์กรหรือบริษัทใด ๆหรือครอบครัว หรือ แขกผู้มาเยือน หมายรวมถึงกัปตัน หรือลูกเรือ ในท่าหรือบนท่าจอดเรือและส่วนใดส่วนหนึ่งของบริเวณหรือสถานที่อำนวยความสะดวกต่าง ๆในบริษัท อ่าวปอ แกรนด์ มารีน่า จำกัด

 “บริษัทเอพีจีเอ็ม” หมายถึง ท่าจอดเรือ บริเวณพื้นที่ท่าจอดเรือทั้งบนบก และ ในน้ำ อันเป็นเจ้าของและสิทธิโดยบริษัท อ่าวปอ แกรนด์ มารีน่า จำกัด (“บริษัทเอพีจีเอ็ม”) ซึ่งรวมถึงทั้งฝ่ายบริหาร ผู้จัดการท่าจอดเรือและพนักงานที่ถูกรวมไว้ในคำว่า “บริษัท” และได้รับอนุญาตให้ใช้กฎข้อบังคับเหล่านี้ บริษัทมีสิทธิที่จะขับไล่เจ้าของ กัปตัน ลูกเรือ หรือ เรือ หรือ ยานพาหนะ ออกจากท่าจอดเรือเมื่อใดก็ได้

(B).Entry into the APGM by water, land or air for any purpose whatsoever entails acceptance of the current and future rules as well as notices and obligation to observe and perform them.

การเดินทางเข้ามาในบริษัทเอพีจีเอ็ม ไม่ว่าจะด้วยการสัญจรทางใด และ/หรือ ไม่ว่าจะเพื่อวัตถุประสงค์ใดก็ตามจะต้องยอมรับในกฎข้อบังคับทั้งหมดที่ทางบริษัทเอพีจีเอ็มได้ระบุไว้ รวมถึงต้องปฏิบัติติตามประกาศ ระเบียบ หรือกฎข้อบังคับใด ๆ ที่จะมีขึ้นในอนาคตและพันธะผูกพันที่จะต้องเชื่อฟังและปฏิบัติตามข้อบังคับเหล่านี้ทั้งหมด

VESSELS REGISTER

(A). All boats kept at the marina must be registered with the marina in a boat register.

The register shall contain the following information:

  • Name(s) of registered owner(s) as per the vessel’s registration
  • Telephone numbers of owner in case of emergency
  • Name of boat
  • Copy of valid boat license for Thailand registered boats
  • Copy of valid boat registration
  • Crew details if crew is staying on the boat or will be accessing the marina in the Licensee absence.
  • Engine and fuel type
  • Beam, draught and length overall (as measured by Ao Po Grand Marina)
  • Proof of valid insurance certificate as per Marina requirements
  • The Marina Manager / Dockmaster shall have the discretion to register or to refuse to register a boat at the Marina.

การลงทะเบียนเรือ

เรือทุกลำที่ประสงค์จะเข้ามาจอดเทียบท่าเรือบริษัท เอพีจีเอ็ม จะต้องทำการลงทะเบียนเรือลำนั้นๆกับทางบริษัท เอพีจีเอ็มอย่างถูกต้องตามรายละเอียดที่ระบุดังต่อไปนี้

  • ชื่อเจ้าของเรือ(ผู้ได้รับอนุญาต หรือ มีใบอนุญาตในการเป็นเจ้าของเรืออย่างถูกต้อง) รวมทั้งเอกสารใบอนุญาตของเรือที่ได้ลงทะเบียนและได้รับอนุญาตถูกต้องตามกฎหมาย
  • เบอร์โทรศัพท์ของเจ้าของที่สามารถติดต่อได้ในกรณีเกิดเหตุฉุกเฉิน
  • ชื่อของเรือ(ตามที่ลงทะเบียน)
  • สำเนาใบอนุญาตของเรือ(สำหรับเรือที่ละทะเบียนในประเทศไทย)
  • สำเนาของใบอนุญาต หรือ เอกสารลงทะเบียนเรือ
  • เอกสารระบุตัวตนของลูกเรือ ในกรณีที่มีลูกเรือเฝ้าอยู่บนเรือ หรือ ในกรณีที่มีลูกเรือผลัดเข้า-ออกภายในเรือ (พร้อมทั้งเอกสารมอบอำนาจโดยเจ้าของเรือผู้มีใบอนุญาต)
  • ชนิดของเครื่องยนต์ และ เชื้อเพลิง
  • ชนิดเรือ ชนิดคานเรือ ขนาดของเรือรวมถึงความสูงเสากระโดง (ซึ่งจะต้องให้ทางบริษัทเอพีจีเอ็มเป็นผู้ตรวจสอบและยืนยัน)
  • เอกสารประกันภัยของเรือที่ยังไม่หมดอายุ ทั้งเอกสารประกันภัยที่บังคับตามกฎหมาย และ เอกสารประกันภัยอื่นๆที่ของเรือ

1. LIEN AND POWER OF SALE

1.1    Owners shall promptly pay to the company all amounts properly due kin respect of Vessels and Vehicles at the APGM. All accounts remaining unpaid for a period in excess of 15days from date of invoice (where there is no notice of dispute) attract interest at 1.25 % per month compounded monthly from date of invoice to date of payment.  The method of presenting the invoice shall be at the sole discretion of the Company.  The invoice may be mailed, email, faxed or hand delivered to the Owner / Captain / Crew of the Vessel Also, the invoice may be placed inside the Vessel.  Upon presentation of the invoice, it will be taken that the Owner / Captain of the Vessel has received the invoice and acknowledged its contents fully.

1. ข้อผูกมัด และ เงื่อนไขในการชำระเงิน

1.1 เจ้าของจะต้องทำการชำระเงินคงค้างตามจำนวนทั้งหมดที่กำหนด ให้แก่บริษัทในทันทีในระยะเวลาไม่เกิน 15 วันนับจากวันที่ระบุไว้ในใบแจ้งหนี้ หากไม่ชำระภายในกำหนดทางเจ้าของจะต้องทำการชำระหนี้โดยคำนวนยอดค้างชำระรวมกับดอกเบี้ยในอัตรา 1.25% ต่อเดือน(คิดเป็น 0.042% ต่อวัน)และสะสมเป็นรายเดือนนับจากวันที่ระบุไว้ในใบแจ้งหนี้จนถึงวันที่มีการชำระ วิธีการเสนอใบแจ้งหนี้จะอยู่ในดุลพินิจแต่เพียงผู้เดียวของบริษัท ใบแจ้งหนี้อาจถูกส่งทางไปรษณีย์ ไปรษณีย์อิเล็คโทรนิค ทางโทรสารหรือส่งให้ถึงมือของเจ้าของ /กัปตัน / ลูกเรือ ใบแจ้งหนี้อาจถูกวางไว้ในเรือ เมื่อมีการนำเสนอใบแจ้งหนี้แล้วจะถือว่าเจ้าของ / กัปตันเรือ ได้รับและรับทราบเนื้อหาสาระของใบแจ้งหนี้ดังกล่าวครบถ้วนแล้ว

1.2       The Company has the right to exercise a general lien upon any Vessels whilst in our upon a berth or elsewhere and any Vehicle at the APGM until such times as any monies due including interest due on late payments to the Company from the Owners whether on account of berthing fees or for work done or for services supplied or otherwise howsoever arising shall be paid.

1.2       บริษัทมีสิทธิที่จะทำการยึดเรือหรือยานพาหนะลำใด ๆ ไม่ว่าเรือหรือยานพาหนะนั้นจะอยู่ในท่าจอดเรือของบริษัทหรือที่แห่งอื่น ๆในพื้นที่หรือนอกพื้นที่ของบริษัท เอพีจีเอ็ม จนกว่าเจ้าของเรือหรือยานพาหนะนั้น ๆจะทำการชำระหนี้ หรือ เงินคงค้างที่ต้องกำหนดชำระรวมทั้งดอกเบี้ยที่ครบกำหนดในการชำระครั้งสุดท้ายให้แก่บริษัทเอพีจีเอ็ม ไม่ว่าจะเป็นค่าจอดเรือ ค่าบริการต่างๆ หรือชิ้นงาน หรือ การว่าจ้างงานที่แล้วเสร็จหรือการให้บริการต่าง ๆที่ทางบริษัทเอพีจีเอ็มได้ทำการจัดหาให้หรือที่เกิดจากสิ่งอื่นใดตามใบแจ้งหนี้จะได้รับการชำระจนครบถ้วน

1.3       In the event that APGM cannot contact the owners after three months and receive no payment. The company has the right to take the owner to court or proceed as the company consider appropriate.

1.3       ในกรณีที่เจ้าของมีการผิดสัญญา หรือ ผิดนัดชำระหนี้เกินกว่า 3 เดือนนับตั้งแต่วันสิ้นสุดกำหนดชำระหนี้ ทางบริษัท เอพีจีเอ็ม มีสิทธิและอำนาจเต็มที่ในการแจ้งดำเนินการตามกฎหมายกับทางเจ้าของตามที่กฎหมายกำหนดไว้สูงสุด

1.4       APGM don’t give credit on fuel unless an arrangement has been made before hand with the management. A Security deposit needs to be given to the company before fuel purchase.

1.4       ในส่วนของการเติมน้ำมันเชื้อเพลิงนั้น จะต้องทำการชำระเงินทันทีที่ทำการเติมน้ำมันเสร็จเรียบร้อย จะไม่มีการคงค้างชำระค่าน้ำมันหรือรอบิลเรียกเก็บค่าน้ำมันในเวลาหรือวันต่อๆไป เว้นเสียแต่ได้ทำการตกลงกับทางบริษัท เอพีจีเอ็ม เป็นครั้งๆไป จึงจะสามารถทำการคงค้างค่าชำระหรือเป็นเครดิตได้

2. SAFETY AND MANAGEMENT

2.1 Vessels moving within the Marina shall not proceed at such speed or in such a manner as may endanger or cause nuisance to other Owners or their Vessels.

2. ความปลอดภัยและการบริหารจัดการ

2.1 เรือต่างๆที่เคลื่อนที่อยู่ภายในท่าจอดเรือนั้น จะต้องไม่มีความเร็วเกินกว่า 5 น็อต(9.26 กิโลเมตรต่อชั่วโมง) หรือขับเคลื่อน หรือ เคลื่อนที่ในลักษณะที่อาจเป็นอันตราย หรือก่อให้เกิดความเดือดร้อนรำคาญแก่เจ้าของเรือรายอื่นรวมไปถึงทางเจ้าหน้าที่ผู้ปฏิบัติติงานบริเวณท่าเรือด้วย

2.2 Owners shall comply with all request of the Company which in its opinion contributes towards the safe and efficient running of the Marina.

2.2 เจ้าของจะต้องปฏิบัติตามคำขอความร่วมมือใดใดทั้งหมดของบริษัท ซึ่งอยู่ภายใต้นโยบายอันมีความเห็นที่สนับสนุนความปลอดภัยและและจะต้องไม่กระทบหรือสร้างความเดือดร้อน รบกวนในการปฏิบัติงานตามหน้าที่ของเจ้าหน้าที่ท่าเรือ

2.3 Swimming, Fishing, Diving, All Water Sports, and Underwater Activities is prohibited in the marina without permission from the marina manager (except to clean hull). Marina users must keep fairways clean and clear and observe the rule of the road Shall keep clear of fairways and observe the Rule of the Road.

2.3 ไม่อนุญาตให้เล่นกีฬาทางน้ำไม่ว่าจะรูปแบบใด เช่น การว่ายน้ำ การตกปลา การดำน้ำ หรือ กีฬา การละเล่น หรือ กิจกรรมทางน้ำอื่นๆ นอกเสียจากจะได้ทำการขออนุญาตและได้รับการอนุมัติจากทางบริษัท เอพีจีเอ็ม (ยกเว้นการทำความสะอาดเรือ) โดยเจ้าของและผู้ใช้งานภายในท่าเรือจะต้องไม่กระทำการอันใดที่เป็นการกีดขวางทางสัญจร และ รักษาความสะอาดทั้งในน้ำและบนบก รวมทั้งการใช้เส้นทางสัญจรจะต้องเป็นไปตามกฎระเบียบข้อบังคับของท่าเรือ

2.4  No drone to be used to film in the marina.

2.4 ไม่อนุญาตให้ใช้อากาศยานไร้คนขับ (โดรน) เพื่อถ่ายภาพท่าจอดเรือและส่วนใดใดที่เป็นของบริษัท เอพีจีเอ็ม

3. NUISANCE

Owners undertake that no noisy, noxious or objectionable engines, radio or other apparatus or machinery shall be operated within the APGM so as to cause any nuisance, annoyance, damage, or inconvenience to the Company or any other users of the APGM.  Halyards and all other loose rigging shall be secured so as not to cause such nuisance or annoyance.

3. ความเดือดร้อนรำคาญ

ไม่ก่อให้เกิดเสียงดังน่ารำคาญ หรือ ก่อให้เกิดมลพิษ ทำให้บริษัทและผู้ใช้งานมารีน่าอื่นๆเกิดความรำคาญใจ การชักใบเรือขึ้นลงและการเก็บสายระโยงเรือควรทำด้วยความระมัดระวัง ไม่ก่อให้เกิดเสียงดัง หรือสร้างความรำคาญต่อเรือ ต่อมารีน่า และ ผู้ใช้งานอื่นๆ

4. DISCHARGE OF REFUSE

4.1 No refuse shall be thrown or permitted to fall overboard or be left on the pontoons, jetties or car parks or disposed of on or into Marina, nor shall oil, petrol, tar, paint or other noxious or deleterious substance or material be discharged on or into Marina other than in receptacles provided for the specific purpose otherwise, all such items shall be removed from the Marina.

4. การปล่อยของเสีย

4.1 ไม่อนุญาตให้ทิ้ง หรือ ปล่อยของเสีย ของอันตราย สารเคมี หรือ วัตถุที่ไม่สามารถย่อยสลายได้ตามธรรมชาติลงในน้ำหรือทิ้งไว้บนโป๊ะ บริเวณท่าเทียบเรือหรือที่จอดรถ หรือทิ้งลงบนหรือเข้าไปในบริเวณท่าจอดเรือ และรวมไปถึงจะต้องไม่ปล่อยให้น้ำมันเครื่อง น้ำมันเชื้อเพลิง น้ำมันดิน สสารหรือวัตถุที่เป็นพิษไหลลงสู่พื้นที่ท่าเรือ และ ในทะเลบริเวณท่าจอดเรือ หรือเป็นอันตรายหรือวัตถุใดๆปล่อยทิ้งบนหรือเข้าไปในท่าจอดเรือ นอกเหนือจากที่บรรจุไว้ในภาชนะที่กำหนดไว้เพื่อจุดประสงค์เฉพาะอื่นๆ รายการดังกล่าวทั้งหมดจะต้องเคลื่อนย้ายออกจากท่าจอดเรือเท่านั้น

4.2 Owners with animals at APGM shall keep them under control. Owners shall ensure that any fouling of the Marina by their animals is cleaned up and not disposed of on or into the Marina basin.

4.2 เจ้าของที่มีสัตว์เลี้ยง หรือ นำพาสัตว์เลี้ยงเข้ามาในบริเวณพื้นที่ท่าเรือ และ บริเวณพื้นที่บริษัทเอพีจีเอ็ม จะต้องคอยดูแลควบคุมสัตว์เลี้ยงเหล่านั้น ทั้งมิให้ทำร้ายบุคคลอื่นหรือทรัพย์สินทั้งเจ้าของอื่นและทรัพย์สินของบริษัท เอพีจีเอ็ม โดยเจ้าของจะต้องจัดการเก็บกวาดมูลของสัตว์เลี้ยงของตนในท่าจอดเรือจะต้องได้รับการทำสะอาดและห้ามทิ้งลงในหรือเข้าสู่อ่าวด้านในของท่าจอดเรือ

5. WORKING PRACTICE

5.1 All person permitted to do minor maintenance work on any vessel at APGM must take all reasonable step to minimize any potential nuisance. Owners shall ensure that no spillage. All waste material must be removed. Owners may have to pay fee to APGM in case of misconduct.

5. การปฏิบัติงาน

5.1 ไม่อนุญาตให้บุคคลใดใดทำงานที่อาจก่อให้เกิดความเดือดร้อนหรือความรำคาญให้แก่บุคคลอื่นหรือสร้างความเสียหายกับเรือหรือส่วนของท่าเรือ การทำงานหรือกิจกรรมแม้จะได้รับอนุญาตแต่จะต้องดำเนินการปฏิบัติตามขั้นตอนอย่างถูกต้อง เพื่อไม่ก่อให้เกิดความเดือดร้อนรำคาญและมีประสิทธิภาพสูงสุด หากเป็นงานซ่อมบำรุงเล็กน้อยบนเรือหรือยานพาหนะ ทางท่าเรือนั้นไม่อนุญาตให้วางหรือทิ้งอุปกรณ์การทาสีหรือสีเคลือบใดๆในพื้นที่ส่วนใดส่วนหนึ่งของบริษัทเอพีจีเอ็มหรือท่าเรือ โดยเฉพาะอย่างยิ่งเจ้าของจะต้องแน่ใจว่าจะไม่มีการหกรั่วไหลของสี หรือ สารเคมี หรือของเหลวใดๆ เลอะเทอะและทำให้เกิดความเสียหายและไม่เรียบร้อยกับท่าเรือและพื้นที่อื่นๆของบริษัท หากไม่ปฏิบัติตามระเบียบดังกล่าว ทางเจ้าของจะต้องเป็นผู้รับผิดชอบจ่ายค่าซ่อมแซมหรือทำความสะอาดในส่วนที่สกปรกหรือเสียหายทั้งหมด รวมทั้งค่าใช้จ่ายหากทางบริษัทต้องทำการเคลื่อนย้ายอุปกรณ์ หรือ วัสดุเหล่านั้นด้วย

5.2 Work permitted under Rule 5.1 above being undertaken afloat is limited to minor running repairs on minor maintenance of a routine nature by the Owner.

5.2 งานที่ได้รับอนุญาตภายใต้กฎข้อที่ 5.1ข้างต้นจะต้องดำเนินการในขณะทีอยู่บริเวณท่าเรือเท่านั้น ซึ่งจะจำกัดให้ทำการซ่อมแซม หรือ การซ่อมบำรุงเล็กน้อยที่เป็นงานประจำของ เจ้าของเท่านั้น

5.3  Prior written consent by APGM is required before any maintenance works on vessel can start. Owners and any representatives must carry out the work tidily under Thai Laws.

5.3  สำหรับงานอื่นใดของเรือลำอื่นๆที่ท่าจอดเรือจะต้องได้รับหนังสือยินยอมจากบริษัทเสียก่อน และเจ้าของตัวแทนเจ้าของ กัปตัน และลูกเรือ จะต้องปฏิบัติให้ถูกต้องตามกฎหมายไทยและภายใต้กฎข้อบังคับที่จัดทำขึ้นเป็นครั้งคราวไปของบริษัทเอพีจีเอ็ม

5.4 No outside contractor or worker may work on a Vessel for reward without the APGM’s written permission which will normally be given to contractors registered with the APGM for that purpose. Contractors and workers must strictly obey Thai Law.

5.4 ไม่อนุญาตให้ผู้รับเหมาหรือคนงานจากภายนอกให้ทำงานบนเรือลำใดลำหนึ่งโดยไม่ได้รับหนังสืออนุญาตจากบริษัทเอพีจีเอ็ม กรณีที่ได้รับหนังสืออนุญาตแล้วเจ้าของ ตัวแทนเจ้าของ กัปตัน และลูกเรือ ต้องปฏิบัติให้ถูกต้องตามกฎหมายไทย

5.5 No person shall be permitted to build any Vessel or complete a part built Vessel on any part of the APGM without obtaining the prior written approval of the Company. Contractors and workers must strictly obey Thai Law.

5.5 ไม่อนุญาตให้มีการผลิต ประกอบคานเรือ หรือสร้างเรือใดๆหรือต่อเติมชิ้นส่วนใดๆของเรือภายในบริเวณท่าที่จอดเรือ หรือ บริเวณพื้นที่ของบริษัทเอพีจีเอ็มโดยไม่ได้รับหนังสืออนุมัติจากบริษัทเสียก่อน กรณีที่ได้รับหนังสืออนุมัติแล้ว เจ้าของและหรือตัวแทนเจ้าของต้องปฏิบัติให้ถูกต้องตามขั้นตอน และ ระเบียบของกฎหมายไทย

5.6 Ensure the water hose pipe is fitted with a spring nozzle so that the water supply shuts off when the hose is unattended.

5.6 การต่อสายฉีดน้ำ หรือ สายยาง หรือ ท่อน้ำจากหัวต่อน้ำของท่าเรือ จะต้องทำการติดตั้งหัวฉีดที่ส่วนปลายอีกข้างของท่อน้ำ หรือ สายยาง หรือ สายฉีดน้ำทุกครั้งเพื่อไม่ให้เป็นการสูญเสียน้ำ หรือ เปิดน้ำทิ้งโดยเปล่าประโยชน์หากไม่มีการใช้งาน

5.7 Any work undertaken at the APGM shall be subject to the Company’s condition of business.

5.7 งานใดๆที่ดำเนินการที่บริษัทเอพีจีเอ็มจะต้องเป็นไปตามเงื่อนไขทางธุรกิจของบริษัท

6. STORAGE OF DINGHIES, ETC.

6.1 Dinghies, tenders and rafts when not in use shall be stowed aboard the Vessel or ashore in the stowage provided.

6. การจัดเก็บเรือบดเล็ก

6.1 เรือบดเล็ก เรือแคนู เรือเป่าลม หรือ ยานพาหนะขนาดเล็กที่มากับเรืออื่นๆ เมื่อไม่ใช้งานจะต้องเก็บรักษาไว้บนเรือหรือสถานที่เก็บที่จัดเตรียมไว้ให้บนฝั่ง โดยทางบริษัทเอพีจีเอ็มจะไม่รับผิดชอบในความเสียหาย หากเกิดเหตุเสียหาย หรือ สูญหายอันเกิดจากเหตุใดใดทั้งสิ้น

6.2  No items of craft gear, cradles, trailers, fittings, equipment, supplies, stores or the like shall be left otherwise than upon a Vessel and in particular not upon the pontoons, jetties or car parks  within the APGM unless otherwise arranged.                                                                                                                                                                                                                                                                                                                          

6.2 ไม่อนุญาตให้วางอุปกรณ์หรือชิ้นส่วนใดใดภายในมารีน่า นอกจากมีการตกลงกัน หรือ ได้รับอนุญาตจากทางบริษัท เอพีจีเอ็ม โดยเฉพาะอย่างยิ่งบนโป๊ะ ท่าเทียบเรือ ทางเดิน หรือที่จอดรถภายในบริษัทเอพีจีเอ็มเว้นแต่จะได้รับอนุญาตจากทางบริษัทเอพีจีเอ็มเป็นที่เรียบร้อย

7. FIRE PROTECTION

7.1 All necessary precautions to prevent the outbreak of fire in or upon Vessel shall be taken. Vessel shall not be refueled within the APGM except at the Fueling Dock. No fuel shall be allowed to be brought into the marina from outside the marina.

7.1 เจ้าของจะต้องปฏิบัติตามระเบียบและขั้นตอนเพื่อป้องกันไม่ให้เกิดอัคคีภัยขึ้นทั้งในตัวเรือ และ บริเวณท่าเรือ ไม่อนุญาตให้เจ้าของทำการเติมน้ำมันด้วยตนเองหรือภายในบริเวณต่างๆของท่าเรือ ยกเว้นที่ท่าจ่ายน้ำมันของบริษัทเอพีจีเอ็ม ไม่อนุญาตให้กักเก็บน้ำมัน หรือ เติมน้ำมัน หรือ ซื้อน้ำมันจากนอกท่าเรือบริษัทเอพีจีเอ็ม

7.2  No dangerous, flammable, poisonous or obnoxious substance, spirit oil or fluid shall be brought to the Marina other  than such substances normally used in connection with Vessels which shall be kept in properly secured containers, staunch against leakage and all bylaws and statutory rules and regulations with regard thereto shall be strictly observed.

7.2 ห้ามนำเอาสารที่เป็นอันตราย ไวไฟ เป็นพิษหรือสารที่ไวไฟและเชื้อเพลิงที่เป็นอันตราย น้ำมันสนหรือน้ำมันก๊าด เข้ามาในท่าจอดเรือ นอกเหนือจากสารต่างๆที่ใช้ตามปกติของเรือ ซึ่งจะต้องเก็บไว้ในภาชนะที่ปิดมิดชิดอย่างถูกต้องและอย่างแน่นหนาเพื่อป้องกันการรั่วไหลและปริมาณการเก็บจะต้องเป็นไปตามเทศบัญญัติและระเบียบข้อบังคับต่างๆตามกฎหมายที่เกี่ยวข้องและจะต้องปฏิบัติตามอย่างเคร่งครัด

7.3 Owner must maintain their vessel in a state of readiness for movement in the case of fire and/or emergency evacuation. Owner will report to the Marina of any major (vessel) breakdown resulting in the vessel being inoperative for more than 48 hours; any action being taken to restore the vessel to operable condition must also be notified. In an emergency, Marina reserves the right, but no the responsibility, to take action necessary and prudent to safeguard Owner’s vessel and adjacent vessel and property of Marina. Owner agrees to pay the Marina all charges for damages to Marina and services rendered on behalf of Owner and Owner’s vessel in an emergency situation, including but not limited to charges for Marina staff, materials, and/or  the cost of hiring a contractor to move and/or remove the vessel and/or to make any repair required to make the vessel safe and free from defects which may endanger life, property or environment.

7.3 เจ้าของเรือจะต้องทำให้เรืออยู่ในสภาพพร้อมเพียงพอที่จะทำการถูกเคลื่อนย้ายในกรณีที่เกิดเหตุเพลิงไหม้ หรือ สถานการณ์คับขันอื่นๆ หากเรือหรือยานพาหนะของเจ้าของมีการเสียหายในระดับที่ไม่สามารถเคลื่อนย้ายเรือออกจากจุดได้เกินกว่า 48 ชั่วโมง ทางเจ้าของเรือหรือยานพาหนะนั้น จะต้องรีบแจ้งทางบริษัทเอพีจีเอ็มให้ทราบถึงสภาพของเรือและยานพาหนะนั้นๆ ในกรณีที่เกิดเหตุฉุกเฉิน ทางบริษัทเอพีจีเอ็มสงวนสิทธิ์ แต่ไม่มีส่วนเกี่ยวข้องหรือ/และไม่ต้องรับผิดชอบใดใด ในการกระทำการแก้ไขปัญหาเฉพาะหน้าอันจำเป็นต่อความปลอดภัยของท่าเรือและเรือลำอื่นๆภายในท่าเรือ ทางเจ้าของเรือที่เป็นผู้เกิดเกิดเหตุจะต้องเป็นผู้รับผิดชอบชำระค่าใช้จ่ายทั้งหมดในการดำเนินการใดใดทั้งสิ้นที่เกิดขึ้นอันเนื่องจากทางบริษัทเอพีจีเอ็มกระทำไปเพื่อควบคุมและแก้ไขปัญหาแทนเจ้าของเรือ ความเสียหายจากอัคคีภัยที่เกิดขึ้นบนเรือของเจ้าของหรือเกิดขึ้นกับทรัพย์สินของบริษัท เอพีจีเอ็ม (เนื่องจากการกระทำหรืองดเว้นการกระทำของเจ้าของ ตัวแทน หรือบริวารของเจ้าของ หรือบุคคลอื่นใดที่เจ้าของหรือตัวแทนเจ้าของได้นำเข้ามาในสถานที่ของบริษัท เอพีจีเอ็ม เพื่อซ่อมแซมเรือโดยชอบด้วยกฎหมาย (ถ้ามี) ของเจ้าของ) เช่น ค่าแรงงาน ค่าวัสดุ อุปกรณ์ เครื่องมือ เครื่องใช้ ในการดับเพลิง ค่าพาหนะในการเดินทาง ค่าใช้จ่ายอื่น ๆ เพื่อให้พนักงานเจ้าหน้าที่ของหน่วยงานราชการและหรือบุคคลที่เกี่ยวข้อง เข้ามาระงับเหตุ ตรวจสอบสถานที่เกิดเหตุ หรือสอบสวน รวมถึงความเสียหายที่บริษัท หรือพนักงานของบริษัทถูกพนักงานเจ้าหน้าที่เรียกเพื่อให้ถ้อยคำ ตลอดจนค่าจ้างนักกฎหมายและใช้จ่ายอื่น ๆ ที่เกิดขึ้นทั้งหมดเนื่องจากเหตุอัคคีภัยดังกล่าว

8. RIGHT TO MOVE VESSELS

APGM reserve the right to move all vessel or carry out works in case of emergency. Owners are responsible for the charges occur.

8. สิทธิในการเคลื่อนย้ายเรือ

บริษัทมีสิทธิที่จะผูกเรือ เทียบเรือ เคลื่อนย้าย ออกเรือ ขึ้นเรือหรือปฏิบัติงานฉุกเฉินใดๆบนเรือ(เว้นแต่เกิดขึ้นจากความประมาทของบริษัทหรือบุคคลใดๆที่บริษัทจะต้องรับผิดชอบหรือเป็นจุดประสงค์ของบริษัทเอง) ทั้งนี้เจ้าของจะต้องเป็นผู้รับผิดชอบค่าใช้จ่ายทั้งหมด

9. PROVIDE DETAILS OF VESSELS MOVEMENTS

Owner of vessels shall notify the Marina Manager in the event of the vessel leaving the APGM and intended time of return where upon the Company shall ensure that the designated berth is available.

9. การให้รายละเอียดในการเคลื่อนที่ของเรือ

เจ้าของจะต้องทำการแจ้งเมื่อมีแผนการจะเดินเรือ ทั้งที่จะออกจากท่าเรือ และ ทั้งแผนที่จะกลับเข้ามาจอดที่ท่าเรือให้แก่ผู้จัดการท่าเรือ หรือ/และ ทางบริษัทเอพีจีเอ็ม

10. MEASUREMENT OF VESSELS

For all purposes vessel length shall be measured including all extensions such as davits, bowsprits, bumpkins, pulpits and pushpits. The Marina Manager may at any time verify the length of any Vessel notified to it by the owner,

ทางบริษัทเอพีจีเอ็มขอสงวนสิทธิ์ในการเข้าไปทำการตรวจวัด ขนาด ความยาว ความกว้าง ความสูง และ ส่วนประกอบต่างๆเช่น เสากระโดง หน้ามุขเรือ หรือ ส่วนอื่นใดของเรือ เมื่อใดก็ได้ แล้วแต่ดุลยพินิจและความเหมาะสมของทางบริษัทเอพีจีเอ็ม

11. NO COMMERCIAL USE OF VESSELS

12.1 No vessel shall be used otherwise than on a personal non-commercial basis and in particular no Vessel or Vehicle shall be offered for sale or hire or charter or be advertised or be permitted to be used for such purposes or for the  purpose of time share, except with the Company’s written permission (at its sole discretion).

11. ไม่อนุญาตให้ใช้เรือเพื่อจุดประสงค์ทางการค้า

11.1 ไม่อนุญาตให้ใช้เรือเพื่อจุดประสงค์อื่นๆนอกเหนือจากพื้นฐานการใช้ส่วนบุคคลที่ โดยเฉพาะอย่างยิ่งจะไม่อนุญาตให้มีการเสนอเรือหรือยานพาหนะใดๆเพื่อการขายหรือการเช่า หรือเช่าเหมาลำหรือทำการโฆษณาหรือเพื่อจุดประสงค์ของธุรกิจการให้บริการที่มีการจัดสรรแบ่งเวลาในการเข้าใช้บริการ เว้นแต่จะได้รับหนังสืออนุญาตจากบริษัท (โดยดุลพินิจแต่เพียงผู้เดียวของบริษัทเอพีจีเอ็ม)

11.2 Owners shall be permitted to arrange a private sale of not more than one Vessel (such Vessel being usually berthed at the APGM) during any one or more periods of twelve consecutive months. In the event of such private sale.

11.2 เจ้าของจะได้รับอนุญาตให้จัดทำการขายเรือเฉพาะส่วนบุคคลที่ไม่เกินหนึ่งลำ ในระหว่างระยะเวลาใดๆหรือมากกว่าสิบสองเดือนติดต่อกันในกรณีของการเสนอขายเฉพาะบุคคล

11.2.1 Owners shall be present at all times during which the Vessel is to be viewed unless other arrangements have been made with the Marina Manager. “For Sale” signs shall not be displayed on the Vessel whilst in the APGM.

11.2.1 ไม่อนุญาตให้แปะ หรือ แขวนป้าย “ขายเรือ” บริเวณรอบตัวเรือหรือในเรือ ในขณะที่เรือจอดเทียบท่าหรืออยู่ในบริเวณบริษัทเอพีจีเอ็ม โดยการฝากขายหรือการขายนั้นจะต้องผ่านการเห็นชอบหรือตรวจสอบจากผู้จัดการท่าเรือ

11.2.2   The Company reserves the right to charge commission on a private sale if these provisions are not adhered to.

11.2.2   บริษัทขอสงวนสิทธิ์ที่จะเรียกเก็บค่านายหน้าสำหรับการเสนอขายเฉพาะบุคคลดังกล่าวถ้าไม่ปฏิบัติตามข้อกำหนดนี้

11.3 The Owners shall notify the Company of intention to sell the Vessel. The Owner shall not instruct any broker without simultaneously instructing the Company’s resident broker to sell the Vessel on similar terms.

11.3  เจ้าของจะต้องแจ้งความจำนงที่จะขายเรือลำนั้นให้บริษัทเอพีจีเอ็มรับทราบ และไม่อนุญาตให้เจ้าของแต่งตั้งนายหน้าใดๆโดยไม่ผ่านบริษัทเอพีจีเอ็ม หรือ เงื่อนไขการขายจะต้องไม่ขัดแย้งและจะต้องอยู่ภายใต้เงื่อนไขการขายเดียวกันกับบริษัทเอพีจีเอ็ม

11.4 The Owner is responsible for the payment of the resident brokers agreed commission if as a result of the resident broker’s introduction such purchaser deals directly with the Owner and buys the Vessel.

 11.4 เจ้าของจะต้องรับผิดชอบชำระค่านายหน้าที่ตกลงกันไว้ให้กับนายหน้าของบริษัทเอพีจีเอ็ม ถ้าการซื้อชายนั้นเกิดขึ้นเนื่องจากการแนะนำของนายหน้าของบริษัทเอพีจีเอ็ม หรือ ทางนายหน้าของบริษัทเอพีจีเอ็มเป็นผู้จบการขายให้

12. REPORT DAMAGE

12. การรายงานความเสียหาย

12.1 Owners or persons responsible for a Vessel or Vehicle shall promptly report to the Marina Manager all damage done to the APGM by the Vessel or Vehicle or to any plant machinery or equipment of the APGM, or any alleged defect in the APGM, or any damage done by the Vessel or Vehicle to any other Vessel or Vehicle.

13.1 เจ้าของหรือบุคคลที่รับผิดชอบต่อเรือหรือยานพาหนะใดๆจะต้องรายงานเมื่อมีความเสียหายเกิดขึ้นกับทรัพย์สินของบริษัทเอพีจีเอ็ม รวมทั้งเครื่องจักรหรืออุปกรณ์เครื่องมือใดๆของบริษัทเอพีจีเอ็ม โดยรายงานให้แก่ให้ผู้จัดการท่าจอดเรือรับทราบในทันที(เป็นการแจ้งในกรณีที่เจ้าของเรือทำความเสียหายให้กับทรัพย์สินของทางบริษัท เอพีจีเอ็ม ให้มาแจ้งทางบริษัทด้วย)

12.2 Only Vessels in seaworthy condition and under their own power will be admitted to the Marina. All Vessels must be insured, registered, identified, equipped and maintained as required by law and safe practice. Vessels must be kept tidy and maintained in good condition so as not to reflect unfavorably on the visual standards of the Marina.

12.2 เรือที่เข้ามาจอดในท่าเรือนั้น จะต้องอยู่ในสภาพที่พร้อมเดินทางในทะเล จะต้องมีประกัน มีใบอนุญาต มีการละทะเบียนถูกต้องตามกฎหมายและมีเครื่องมือเพียงพอตามมาตรฐาน เรือจะต้องมีการดูแลซ่อมแซมให้อยู่ในสภาพพร้อมและมีความปลอดภัยในการใช้งาน เพื่อกันมิให้เกิดความเสียหายหรือความผิดปกติต่อการใช้งาน อันจะส่งผลกระทบต่อท่าเรือ

13. MOORING OF VESSELS

13. การจอดเรือ

13.1 No vessel shall be anchored in the Marina nor moored in such a way as to cause any obstruction to the Company or any other Marina user.

13.1 ห้ามเรือใดๆที่ทอดสมอในท่าจอดเรือหรือทอดสมอในลักษณะที่จะเป็นสิ่งกีดวางใดๆของบริษัทและผู้ใช้ท่าจอดเรือรายอื่นๆ

13.2 Vessels shall only be moored to bollards and equipment designated for such purpose and in such a manner and within berths or such other position as the Company may reasonably require and unless otherwise agreed. The necessary wraps and fenders shall be provided by Owners and Owners shall be responsible to ensure that all such warps and fenders are adequate and replaced, maintained and adjusted as necessary. No vessel shall be made fast to any other Vessel within the APGM without the previous consent of the Company and / or the owner or person in charge of the other Vessel.

13.2  เรือต่างๆจะต้องทอดสมอเรือไว้กับเสาผูกเรือ และ/หรืออุปกรณ์ที่กำหนดให้สำหรับจุดประสงค์ดังกล่าวและในลักษณะที่ท่าเรือกำหนดให้ และภายในท่าเทียบเรือหรือในตำแหน่งอื่นใดที่บริษัทกำหนดให้ เว้นแต่จะตกลงกันเป็นอย่างอื่นไว้แล้ว สิ่งป้องกันการกระแทกที่จำเป็น(เฟนเดอร์) ทางเจ้าของเรือหรือยานพาหนะ จะต้องเป็นผู้จัดเตรียม และเจ้าของจะต้องแน่ใจว่าสิ่งป้องกันการกระแทก(เฟนเดอร์) ดังกล่าวนั้นเพียงพอและต้องอยู่ในภาพดี จะไม่มีเรือที่ได้รับการยกเว้นนอกเสียจากจะได้รับการยินยอมจากท่าเรือ และ/หรือบุคคลที่เป็นผู้รับผิดชอบ

14. CAR PARKING

14. การจอดรถยนต์

14.1 Under no circumstances may any Vehicle or trailer be parked so as to obstruct the roadways, walkways, footpaths, slipways, craneage platform or any working area within the APGM.

14.1 ไม่อนุญาตให้รถ หรือ ยานพาหนะใดใดก็ตาม จอดกีดขวางการจราจร ทางสัญจรของรถยนต์สาธารณะ หรือ ทางเดินซึ่งอยู่ในบริเวณพื้นที่ของบริษัทเอพีจีเอ็ม

14.2 No tent, caravan (motor or trailer) or other Vehicle adapted for sleeping may remain on any part of the APGM between the hours except with the written consent of the Marina Manager.

14.2 ห้ามกางเต็นท์ ตั้งกองคาราวาน (รถยนต์หรือรถพ่วง) หรือยานพาหนะอื่นๆที่ดัดแปลงไว้เพื่อการนอนค้างคืนที่อาจคงเหลือในส่วนใดส่วนหนึ่งของบริษัทเอพีจีเอ็มตลอด 24 ชม.เว้นแต่จะได้รับหนังสือยินยอมจากผู้จัดการท่าจอดเรือ

14.3 At all times whilst a berth holders Vehicle is parked within the APGM, the Owner shall display on the front windscreen of the Vehicle a car parking permit obtained from the Company.  The owner will notify the Company of the registration number of all vehicles regularly parked in the APGM.

14.3 ตลอดเวลาที่มีบัตรอนุญาตจอดรถยนต์ที่ได้รับจากบริษัทภายในพื้นที่ของบริษัทเอพีจีเอ็ม เจ้าของจะต้องแสดงไว้บนกระจกหน้าของยานพาหนะดังกล่าว เจ้าของจะต้องแจ้งบริษัทให้ทำการจดทะเบียนจำนวนของยานพาหนะทั้งหมดที่จอดในพื้นที่ของบริษัทเอพีจีเอ็มเป็นประจำ บัตรจอดรถที่ได้รับอนุญาตจากทางบริษัท เอพีจีเอ็มนั้น เจ้าของจะต้องทำมาวางไว้ที่กระจกหน้ารถให้ได้เห็นชัดเจน และ เจ้าของเรือที่ประสงค์จะทำการจอดรถยนต์นั้นจะต้องทำการแจ้งเลขทะเบียนรถยนต์ทุกคันกับทางบริษัท เอพีจีเอ็ม เพื่อทำการออกบัตรอนุญาตในการจอดรถยนต์ภายในพื้นที่บริษัท

14.4 No busses that carry more than 20 passengers will be allowed to the car park to pick up or drop off passengers.

14.4 ห้ามรถโดยสารที่บรรทุกผู้โดยสารมากกว่า 20 คน จอดในที่จอดรถเพื่อรับ-ส่ง ผู้โดยสารภายในพื้นที่และโดยรอบบริเวณของบริษัทเอพีจีเอ็ม

15. INDEMNITY

15.การชดเชยค่าเสียหาย

15.1 All vessels, tenders and dinghies and Vehicles and trailers are within the APGM at the Owners risk. The owner is responsible of his or her own properties and APGM is not responsible for any lost or damage.

15.1 เรือ เรือแคนู และเรือบดเล็กทั้งหมดที่มีและยานพาหนะและรถพ่วงที่อยู่ในพื้นที่ของบริษัทเอพีจีเอ็มจะต้องรับความเสี่ยงโดย เจ้าของเอง และเจ้าของตกลงเป็นผู้รับผิดชอบในความสูญหายหรือเสียหายทั้งหมดที่เกิดขึ้นกับเรือ ยานพาหนะดังกล่าว ตลอดจนทรัพย์สินใด ๆ ของเจ้าของแต่เพียงผู้เดียว  ไม่ว่าความสูญหายหรือเสียหายนั้นจะเกิดขึ้นเนื่องจากเหตุโจรกรรม อุบัติเหตุ หรือด้วยเหตุอื่นใดก็ตาม

15.2 Owners shall indemnify and keep the Company indemnified from and against all actions, proceeding, claims, demands, costs, expenses, losses and liabilities occasioned by or arising from:

15.2 เจ้าของจะต้องชดใช้ให้บริษัทและช่วยให้บริษัทรอดพ้นจากการฟ้องร้อง การดำเนินคดี การเรียกร้อง คำสั่ง ต้นทุน ค่าใช้จ่ายความเสียหายและหนี้สินทั้งหมดที่เกี่ยวข้องกับ หรือที่เกิดขึ้นจากเหตุการณ์ใดๆดังต่อไปนี้(เจ้าของจะต้องเป็นผู้รับผิดชอบแต่เพียงผู้เดียว)

15.2.1The breach of any of these Rules.

15.2.1 การละเมิดข้อกำหนดใดๆของกฎข้อบังคับเหล่านี้(ทำผิดกฎระเบียบข้อบังคับ)

15.2.2 Any damage or injury suffered by any person whomsoever or any property whatsoever by or in the course of the exercise or any rights in the APGM by any act, default, neglect or omission of the Owner.

15.2.2 ความเสียหายหรือการบาดเจ็บที่เกิดขึ้นกับทรัพย์สิน หรือ บุคคลใดๆที่เกิดขึ้นจากการกระทำ กิจกรรมของเจ้าของ อันเกิดจากความประมาทเลินเล่อ ขัดคำสั่ง ของตัวเจ้าของเอง

15.2.3 Conducting any activity which contravenes local and national law.

15.2.3 การกระทำ กิจกรรมใดๆที่ขัดต่อกฎหมายท้องถิ่นและกฎหมายระดับชาติ

16. Others   ข้อตกลงอื่น ๆ

16.1 Any dispute, controversy or claim arising out of or relating to a Berth Contract, these Rules, or any other matter at the Marina, including any question regarding the existence, breach, termination or invalidity thereof shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Thailand Arbitration Center in force at the time, and shall be under the administration of the Thailand Arbitration Center(THAC). The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Bangkok. The language to be used in the arbitral proceedings shall be English. The Rules shall be construed and interpreted in accordance with the law of Thailand and the Thai courts shall have exclusive jurisdiction.

16.1 กรณีที่มีข้อความใดในภาษาไทยขัดหรือแย้งกับข้อความใดในภาษาอังกฤษ ทั้งสองฝ่ายตกลงให้ใช้ข้อความภาษาไทยบังคับทุกประการ
